Is marijuana use legal in Florida?

Florida passed the legalization of medicinal marijuana in 2016, but the state has just started issuing ID cards allowing its use. According to the Sun Sentinel, over 100,000 people have registered to use medical marijuana across the state. However, the state still bans all smokable forms of the drug.


What does that mean for Florida residents?

For those who cannot register for medical marijuana, it means you are out of luck currently. For many marijuana proponents, that does not sit well. Regulate Florida, is an organization pushing for marijuana’s legalization in Florida. The group wants marijuana to be handled like alcohol and tobacco.

The group recently faced a setback. Regulate Florida hoped to gather the 766,000 signatures needed to get legalization placed on the ballot for November 2018. The group fell woefully short with just 40,000 signatures for their February 1st deadline.

What happens next for legalization?

The group and other supporters are now focused on the 2020 election. The signature goal remains the same for the next election, but this time, there are two years to gather support and signatures. Still, the group is concerned because they fell so far short of their last goal. They likely will need more money and better organization to spur on the campaign for 2020.

Except for those with an ID card for medical use, marijuana is still illegal to possess in Florida. All smokable versions of drug continue to be banned. If you are arrested with less than 20 grams of marijuana in Florida, it is a misdemeanor. You could face up to a year in jail and a fine. If you are found in possession of over 20 grams, you could face a fine and up to five years in jail.
