Penalties for minors using Juul devices

The popular e-cigarette brand Juul Labs is under investigation for targeting advertisements toward minors. There have been three recent lawsuits against the $15 billion vaping company alleging the thumb drive e-cigarette caused users to become addicted to nicotine. One of the Juul lawsuits was filed by the parents of 15-year-old Juul user.

As studies show a hike in high-schoolers using e-cigarettes, it’s important that students remember there are legal penalties for any person under 18 years of age who knowingly possesses or attempts to obtain any nicotine product or a nicotine dispensing device.

According to Florida legislation, individuals can also face consequences for misrepresenting their age to purchase a nicotine product or a nicotine dispensing device.

If caught, the severity of the penalty a minor may face depends on the number of offenses the individual has had.

First offense

The first time someone under the age of 18 years old is found in possession of a nicotine dispensing device, such as a Juul e-cigarette, the defendant may face 16 hours of community service within a 12-week period or a $25 fine.

The minor will also need to attend a school approved anti-tobacco program.

Second offense

A subsequent offense will be chalked up as a secondary offense if it occurs within 12 weeks of the first offense. A secondary offense will result in another $25 fine.

Third or subsequent offenses

If an individual under the age of 18 is in position of nicotine or a nicotine dispensing devise for the third time within twelve weeks of the previous offenses, the minor’s driver’s license or driving privileges may be suspended or revoked by the Department of Highway Safety and Motor Vehicles. The court may also withhold issuance of the minor’s driving privileges.

Some police officers and specifically designated to act as a tobacco product enforcement officer. These officers are likely to issue minors a citation for possessing or attempting to purchase tobacco products.
