Florida’s zero tolerance law: High stakes for young drivers

On Behalf of | Aug 26, 2025 | Drunk Driving

If you’re a young driver in Florida, it’s critical to understand the state’s strict DUI laws. For drivers under 21, the rules are different and the consequences severe. One wrong choice can lead to immediate and long-term ramifications. Florida’s “zero tolerance” policy is a strict standard to keep young drivers and everyone else on the road safe.

What does zero tolerance mean?

Zero tolerance” means you cannot have any alcohol in your system while driving. For drivers under 21, the legal blood alcohol content (BAC) is just .02, much lower than the .08 for adult drivers. Even a single drink can put you over the limit.

Understanding the penalties

Consequences for an underage DUI can be significant. It’s important to know exactly what you face if you violate the law. A first offense with a BAC of .02 or higher typically results in a six-month license suspension.

A second offense for the same BAC level means you’ll lose your license for one year. If you refuse to submit to a breath test, you face an immediate one-year license suspension for a first refusal. A second refusal can suspend your license for 18 months. These aren’t criminal charges, but they have a powerful effect on your life.

Mandatory education and rehabilitation

In addition to license suspensions, the law requires you to take specific courses. If your BAC is .05 or higher, your license suspension will continue until you complete a substance abuse course and an evaluation, which is required before you can reinstate driving privileges.

Drivers are responsible for the cost of the substance abuse course. For those under 18, a parent or legal guardian is notified of the evaluation results. You may also be required to complete a “Traffic Law and Substance Abuse Education” course.

Drive responsibly to protect your future

The penalties for underage DUI in Florida can have a lasting impact on your life, your education and your career. Understanding these laws is the first step toward protecting yourself. Always make the wise choice to avoid alcohol if you are going to drive. If you are arrested, seeking skilled legal guidance is a vital step to protect your license and future.
