Denied bond in Broward? Understanding a Nebbia hold

You get the call and rush to secure the bail for your loved one. You have the necessary amount of cash ready to bring your husband or family member home, but the jail refuses to process the release.

They tell you there is a “Nebbia hold” on the case. While this procedural obstacle often feels like a dead end, it remains a standard protective measure in South Florida courts.

What is a Nebbia hold?

Standard bail ensures a defendant returns to court. However, courts in Broward County are increasingly concerned with where the bail money comes from. A Nebbia hold allows the court to detain a defendant until they prove the money used for bond did not come from illegal activities.

Under Florida law, a judge considers the source of funds when determining bail. The goal is preventing defendants from using illicit profits to buy their freedom and flee. While this sounds intimidating, it is essentially a request for financial transparency.

Proving the funds are clean

To lift the hold, an attorney compiles a “Nebbia proffer.” This is a packet of financial documents presented to the prosecutor and judge to trace the origin of the bond money. If the funds are legitimate, the court may remove the hold.

To speed up this process, it is often vital to immediately gather the following records:

  • Bank statements: Provide the last three to six months of statements for the account holding the bond money.
  • Proof of income: Locate recent pay stubs, W-2 forms or tax returns from the previous year to verify employment.
  • Loan documentation: Secure a notarized sworn statement and loan agreement if a friend or relative lends you the money.
  • Asset records: Copy mortgage deeds or vehicle titles if you used a property as collateral.

Having these documents ready allows the defense team to move quickly.

Negotiating a stipulation for release

Once the necessary documents are organized, a lawyer can often negotiate a stipulation with the prosecutor to lift the hold without a formal hearing. This allows your loved one to return home while the defense team begins working on the criminal defense strategy. Swift action is necessary to navigate these banking requirements and secure release.
